These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you and Clever Solutions, Inc., a California corporation doing business as SafetyVideos.com (“we,” “us,” or “our”), concerning your access to and use of our website and the purchase of our products and services.
1. Agreement to Terms
By accessing the site or purchasing our materials, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the site and must discontinue use immediately.
2. Intellectual Property Rights
Unless otherwise indicated, the site and all content (including videos, text, graphics, and logos) are the proprietary property of Clever Solutions, Inc. and are protected by copyright and trademark laws.
- Physical Media: Purchase of a DVD or physical training kit grants you a non-exclusive license to use the materials for internal company training purposes only.
- Online Training: Online courses are provided via a limited, non-transferable license for the specific number of users purchased. Sharing login credentials with unauthorized users or outside organizations is strictly prohibited.
- Prohibited Acts: You may not record, copy, redistribute, or publicly broadcast our videos without express written consent from Clever Solutions, Inc.
3. Educational Records and Certificates (FERPA)
Clever Solutions, Inc. acknowledges that training certificates and course completion data may be considered “educational records” under the Family Educational Rights and Privacy Act (FERPA) when provided to educational institutions.
- We act as a School Official with a legitimate educational interest in maintaining these records.
- We agree to maintain the confidentiality of these records and will not disclose them to third parties except as required to fulfill our services or as required by law.
4. Safety and Liability Disclaimer (READ CAREFULLY)
Clever Solutions, Inc. provides training materials for informational and educational purposes only.
- Not Legal Advice: Our content is intended to assist in safety training but does not constitute legal advice or a definitive interpretation of OSHA or other regulatory standards.
- No Guarantee of Safety: Successful completion of a video or course does not guarantee that a workplace will be free from hazards. Hands-on, site-specific training remains the responsibility of the employer.
- Limitation of Liability: To the fullest extent permitted by law, Clever Solutions, Inc., its officers, employees, and content creators shall not be held liable for any workplace injuries, fatalities, property damage, or regulatory fines resulting from the use or misuse of the information provided in our materials.
5. Data Security
We maintain industry-standard administrative and technical safeguards to protect your data, including training records and payment information. This includes the use of SSL/TLS encryption for all data transmissions and secure, restricted-access databases managed by Clever Solutions, Inc.
6. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California. You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California.
7. Arbitration and Class Action Waiver
Any dispute arising from these Terms shall be resolved through binding arbitration in San Diego, CA. You waive your right to participate in a class-action lawsuit or class-wide arbitration.
8. Modification of Terms
Clever Solutions, Inc. reserves the right to update or change these Terms at any time. Your continued use of the site after changes are posted constitutes your acceptance of the revised Terms.
